These Terms and Conditions set out the rules for using the online store operating at catura.pl.

§1 General Provisions

1. The online store available at catura.pl (hereinafter: the „Store”) is operated by Aktro sp. z o.o. with its registered office in Białystok (15-124 Białystok), ul. Gen. Władysława Andersa 7 lok. 4, entered into the register of entrepreneurs of the National Court Register (KRS) kept by the District Court in Białystok, XII Commercial Division of the National Court Register, under KRS number 0001023946, NIP (Tax ID) 1251626720, REGON 147305079, share capital PLN 50,000.00 (hereinafter: the „Seller”).

2. These Terms and Conditions set out the rules for using the Store, including the rules for concluding distance sales contracts, placing Orders, delivering ordered Products, paying the purchase price, the Buyer’s right to withdraw from the contract, and the rules for filing and handling complaints.

3. The Seller may be contacted by e-mail at miau@catura.pl and by post at the registered office address indicated in section 1.

§2 Definitions

Store – the online store available at catura.pl.
Seller – Aktro sp. z o.o., details as in §1(1).
Buyer / Customer – a natural person, legal person, or organizational unit without legal personality, placing an Order in the Store.
Consumer – a Buyer who is a natural person making a purchase not directly related to their business or professional activity.
Product – a movable item available for purchase in the Store.
Order – a declaration of intent by the Buyer aimed at concluding a contract of sale of a Product.

§3 Technical Requirements

To use the Store, including browsing the assortment and placing Orders, the following are required: a device with Internet access, an up-to-date web browser, and an active e-mail account.

§4 Placing Orders

1. Orders may be placed 24 hours a day through the Store.

2. Placing an Order does not require account registration – purchases as a guest are possible.

3. Placing an Order requires reading and accepting these Terms and Conditions.

4. After placing an Order, the Buyer receives confirmation of its receipt at the provided e-mail address. The sales contract is deemed concluded upon the Seller’s confirmation of acceptance of the Order.

§5 Prices and Payments

1. All Product prices given in the Store are gross prices (including VAT). Prices are expressed in Polish złoty (PLN) or euro (EUR), depending on the language version of the Store selected by the Buyer.

2. The price given for a Product at the time of placing the Order is binding on both parties.

3. Available payment methods will be indicated to the Buyer each time during the order placement process.

4. At the Buyer’s request, made during the order placement process, a VAT invoice may be issued for the Order.

§6 Delivery

1. Delivery of Products is carried out within the territory of the Republic of Poland as well as to selected European Union countries and other countries indicated in the Store.

2. Delivery within the territory of the Republic of Poland is free of charge for all Orders, regardless of their value. The cost of delivery outside Poland is indicated to the Buyer before placing the Order and depends on the destination country.

3. The standard shipping time for an Order is up to 24 business hours from the moment payment is credited.

4. Delivery time additionally depends on the chosen carrier and usually takes 1 to 3 business days from the date of shipment.

§7 Right of Withdrawal

1. A Consumer who has concluded a distance contract may, within 14 days, withdraw from it without giving any reason and without incurring costs, except for the costs indicated in section 5 below.

2. The withdrawal period begins on the day the Consumer takes possession of the Product.

3. The Consumer may withdraw from the contract by submitting an unambiguous statement of withdrawal to the Seller, e.g. by e-mail. A model withdrawal form is available on the Returns Policy page.

4. The Seller shall, promptly and no later than within 14 days of receiving the statement of withdrawal, refund all payments made by the Consumer, including the cost of delivering the Product (except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller).

5. The Consumer shall bear the direct cost of returning the Product to the Seller.

6. The Consumer is liable for any decrease in the value of the Product resulting from using it in a way that goes beyond what is necessary to establish its nature, characteristics, and functioning.

7. The right of withdrawal does not apply to the Consumer with respect to contracts referred to in Article 38 of the Polish Act of 30 May 2014 on Consumer Rights, in particular for Products made to the Consumer’s individual specification.

§8 Complaints

1. The Seller is obliged to deliver a Product free of defects and is liable to the Consumer under statutory warranty on the terms set out in the Polish Civil Code.

2. A complaint should be submitted to the e-mail address miau@catura.pl or in writing to the Seller’s registered office address, describing the reason for the complaint and the Buyer’s request.

3. The Seller will respond to the complaint within 14 days of its receipt.

§9 Out-of-Court Complaint and Redress Procedures

1. The Consumer has the option of using out-of-court methods of handling complaints and pursuing claims, including by filing a request to initiate mediation with the relevant provincial inspector of the Trade Inspection, or by applying to a permanent consumer arbitration court.

2. The Consumer may also use the ODR platform, available at: ec.europa.eu/consumers/odr.

3. Detailed information on out-of-court complaint handling is available on the website of the Office of Competition and Consumer Protection (uokik.gov.pl).

§10 Personal Data

The rules for processing Buyers’ personal data are described in the Privacy Policy available on the Store’s website.

§11 Final Provisions

1. The Seller reserves the right to introduce changes to these Terms and Conditions. Changes to the Terms and Conditions do not affect Orders placed before the effective date of the changes.

2. In matters not regulated by these Terms and Conditions, the applicable provisions of Polish law shall apply, including the Civil Code and the Act of 30 May 2014 on Consumer Rights.

3. These Terms and Conditions enter into force on the date of publication.
